Update to SmartPosti general contract terms: change in liability rules for parcel services

We would like to inform our private customers that an update has been made to section 10.4.2. Postal services and Transportation of parcels in SmartPosti’s general contract terms.

The updated terms clarify how compensation is handled in cases where a parcel is lost or damaged, and which services have a fixed maximum compensation.

What has changed?

Previously, SmartPosti’s liability was based on the CMR Convention, with a fixed maximum compensation of €500 for certain delivery services used within the Baltic States and Finland.

The updated terms now include a clearer and more detailed list of the services for which the €500 maximum compensation per shipment applies.

Updated liability clause

In the case of postal service provision, damages are compensated in accordance with mandatory applicable legislation and industry practice. SmartPosti is liable for the loss or damage of a shipment under the CMR Convention, up to 8.33 SDR per kilogram of the shipment’s gross weight, except when using the following services:

  • Express Parcel

  • Home Parcel

  • Postal Parcel SmartPost

  • SmartCourier services

  • Parcel Connect Baltics (only in the Baltic States and Finland)

  • Express Business Day Parcel services

For these services, SmartPosti’s liability is limited to €500 per shipment (maximum compensation amount).
